Appraiser in courtroom:

Appraisal assignments are requested for a variety of intended uses. For residential appraisers the most common intended use is mortgage lending, and many (residential) appraisers decline appraisal requests for intended uses that may result in litigation. However, even a mortgage lending assignment may result in the need for an appraiser to become involved in the legal system, as a witness or as a defendant. Issues such buyer remorse, contamination, structural deficiencies, easements and bias have been referenced in allegations against appraisers. This course is designed to acquaint an appraiser with factors to consider when/if the appraiser is subpoenaed to appear in court.

Objectives

• Become familiar with litigation-related terminology
• Become familiar with litigation-related procedures and process
• Understand need for professional appraisals and reports
• Recognize differences between mortgage lending and litigation assignments
• Letters of engagement, fees
• Scope of work
• Reporting, including forms
• Become a credible expert witness (even if you didn’t “volunteer” for it)

This course has been approved by the Minnesota DOC for 4.0 hours of Appraisal and Real Estate CE.
